THIS DOCUMENT IS AN ELECTRONIC RECORD IN TERMS OF THE INDIAN CONTRACT ACT 1872; THE INFORMATION TECHNOLOGY ACT 2000, THE RULES MADE THEREUNDER; AND THE AMENDED PROVISIONS PERTAINING TO ELECTRONIC RECORDS IN VARIOUS OTHER STATUTES AS AMENDED BY THE INFORMATION TECHNOLOGY ACT, 2000. THIS ELECTRONIC RECORD IS GENERATED BY A COMPUTER SYSTEM AND DOES NOT REQUIRE ANY PHYSICAL OR DIGITAL SIGNATURES.

These Terms of Service (the “Terms") govern how Users (Candidates and Hiring Entities) access and use the website, AI-powered technical assessment services, and remote proctoring tools provided by InterviewMix.com (“Platform,” “we,” “us,” or “InterviewMix”) (collectively, the “Services”).

By accessing our Platform to take or administer an assessment, Users acknowledge that they have read these Terms and explicitly agree to be bound by the rules, liabilities, and obligations described herein.

Subject to applicable laws, these Terms (and any subsequent updates) shall apply retrospectively to all actions, uses, and interactions on and from the date of a User's very first interaction with the Platform.

Strict Requirement:IF A USER DOES NOT AGREE TO THESE TERMS, THEY MUST IMMEDIATELY CLOSE THEIR BROWSER AND ARE STRICTLY PROHIBITED FROM ACCESSING ANY SERVICES PROVIDED BY INTERVIEWMIX.COM.

1. Definitions & Legal Roles

To ensure absolute transparency regarding platform usage, data processing, and legal liability, we clearly define the roles of all parties:

  • "User": A universal, collective term referring to any individual, business, or automated system that accesses, browses, or utilizes the Platform in any capacity. This encompasses Candidates, Hiring Entities, Account Owners, Account Admins, and general website visitors.
  • "Candidate" (Data Principal): An individual taking a technical assessment or recording an interview on the Platform.
  • "Hiring Entity" (Data Fiduciary): ANY business entity, recruiter, organization, hiring company, hiring manager, or any person hiring using InterviewMix.com (acting as or represented by an Account Owner or Admin) that invites a Candidate, assigns a test to a Candidate, and/or reviews a Candidate's results. This includes, but is not limited to:
    • Registered Companies (Pvt Ltd, LLC, Inc, Non-Profits, etc.)
    • Sole Proprietors & Freelancers
    • Recruitment Agencies & Staffing Firms
    • Individuals sending tests
    They own the assessment data, determine the purpose of the data collection, and are solely responsible for all final employment decisions.
  • "Account Owner" (Master Account): The primary entity or individual who subscribes to InterviewMix.com for sending/conducting interviews, holds the billing relationship, legally binds the Hiring Entity, and has full rights to utilize assessment credits within given time limits.
  • "Account Team Member / Admin" (Sub-Account): Any optional individual (including, but not limited to, HR, Hiring Manager, or Recruiter) invited by the Account Owner to join their workspace and administer tests using the Master Account's resources.
  • "InterviewMix.com" (Data Processor): InterviewMix.com acts strictly as the technical infrastructure provider. InterviewMix.com processes Candidate data solely on behalf of, and under the instructions of, the Hiring Entity.
  • Exceptions to our Data Processor Role: InterviewMix.com acts as an independent data controller/fiduciary only for the following limited technical operations:
    • Statistical Benchmarking (Percentile Calculation): InterviewMix.com retains numerical assessment scores and evaluation ratings in a permanently de-identified and aggregated format. This data is decoupled from the Candidate's personal identity and stored indefinitely to calculate global platform performance benchmarks, allowing InterviewMix.com's system to accurately determine which percentile a Candidate sits in relative to the historical testing pool.
    • AI Model Improvement: For optional features described in the "AI Model Improvement" section, InterviewMix.com processes data based solely on the Candidate's explicit consent.
  • "Services" / "Platform": The entire suite of tools provided by InterviewMix.com, including, but not limited to, Candidate Assessments, remote proctoring, and AI analysis.
  • "The Agreements": Refers collectively to the Terms of Service (TOS), the Master Services Agreement (MSA), and the Privacy Policy, which collectively govern the usage of the Platform.

2. Services & Legal Framework

2.1 Applicability of Agreements

For Hiring Entities: A Hiring Entity's use is governed by the MSA, these Terms of Service (TOS), and the Privacy Policy.
For Candidates: A Candidate's use is governed strictly by these Terms of Service (TOS) and the Privacy Policy. (The commercial MSA does not apply to Candidates).

2.2 Binding Acceptance

Hiring Entity Acceptance

The Account Owner and Account Team Members are strictly prohibited from accessing the dashboard until they have explicitly accepted the terms via Email Confirmation, digital signature, or physical signature. If a Hiring Entity accesses InterviewMix.com without completing these methods—regardless of the means by which such access was obtained—they are not legally authorized to use the Services (including, but not limited to, initializing an account, accessing dashboard data or candidate data, or conducting any assessment). Such usage constitutes "Unauthorized Access" under the Information Technology Act, 2000.

Candidate Constructive Consent

By opening InterviewMix.com and clicking on buttons including, but not limited to, "Start Assessment", "Login", "Sign In", or "Sign Up", or by accessing any assessment URL provided by a Hiring Entity, the Candidate confirms their binding acceptance of these Terms. If a Candidate does not agree, they must close the browser window immediately and must not proceed with the assessment.

2.3 Order of Precedence & Complementary Reading

In the event of a direct conflict or inconsistency between the documents, they shall control in the following order of priority:

  1. The Privacy Policy (Controls for data privacy and handling).
  2. The Master Services Agreement (MSA) (Controls for commercial and billing terms for Hiring Entities).
  3. These Terms of Service (Controls for general platform usage and candidate behavior).
Complementary Documents: The Agreements are intended to be complementary and read together as a whole. If a specific provision, restriction, or rule exists in one document but is absent from another, it does not constitute a "conflict," and the provision shall apply to the User as written.

3. Payments, Credits & Refunds

The following terms govern all billing, payments, free plans, and credit allocations for all Users (including Hiring Entities purchasing assessment credits and Candidates purchasing practice plans), whether acquired via online self-serve portals, offline invoicing (including, but not limited to, email or phone sales), or promotional grants.

Interaction with Master Services Agreement (MSA) & Entire Agreement
  • For Hiring Entities (MSA is Mandatory): A Hiring Entity is strictly prohibited from accessing or using the Platform without a valid Master Services Agreement (MSA) in place (whether mutually signed offline or digitally accepted during account creation). These Terms apply in conjunction with that MSA. If a direct conflict arises between the MSA and these Terms regarding specific payment clauses (e.g., custom invoicing timelines), the MSA shall override these Terms solely to the extent of that specific direct conflict. All non-conflicting provisions of this section (including, but not limited to, refund policies, dispute liabilities, and credit expiration) shall remain in full force and effect.
  • For Candidates (TOS is Exclusive): Candidates do not enter into an MSA. For Candidates (including those purchasing practice plans), this Terms of Service document constitutes the entire and exclusive legal agreement regarding payments, credits, and platform usage. No verbal agreements, email communications, support tickets, or external promises shall override, modify, or supersede these strict Terms of Service.

3.1. Payment Methods & Offline Purchases

  • Accepted Methods: Available payment methods will be presented to the Users (Hiring Entities and Candidates) at the time of checkout or upon invoice generation. While we may support a variety of online payments (including, but not limited to, credit/debit cards, wallets) and offline/manual payments (including, but not limited to, UPI, NEFT/RTGS), InterviewMix.com reserves the right to restrict, enable, or disable specific payment methods at any time in its sole discretion (including, but not limited to, based on geographic location and rolling out phases).
  • Offline Payment Clearance: For purchases negotiated via email, phone, or manual invoice, assessment or practice credits will be provisioned strictly after the funds have successfully cleared and settled into the corporate bank account of InterviewMix.com (or its registered parent legal entity). We do not provision access based on payment receipts or screenshots.

3.2. Free Plans & Promotional Credits

During promotional events or through free-tier plans, InterviewMix.com may allocate free credits to Users.

  • Zero Cash Value: Promotional or free credits have absolute zero cash value, cannot be exchanged for money, and are strictly non-transferable between accounts.
  • Right to Revoke: InterviewMix.com reserves the absolute right to modify, reduce, expire, or fully revoke free/promotional credits at any time, for any reason, without prior notice or liability.

3.3. Subscription Plans (Online Auto-Renewal)

  • Recurring Billing & Auto-Renewal: For plans requiring a saved payment method, subscriptions automatically renew at the start of each billing cycle at the then-current rate. To avoid renewal charges, the User must cancel the subscription at least twenty-four (24) hours before the current billing cycle ends.
  • Upgrades & Downgrades: Upgrades are effective immediately, and the User will be charged the pro-rata difference. Downgrades take effect strictly at the start of the next billing cycle.
  • Failed Payments & Account Access: Because our Platform operates on a prepaid credit system, if a payment method fails for a purchase or subscription renewal, the User account will not be suspended and the User will retain full access to their historical dashboard. However, new credits will not be allocated to their workspace. Because actions such as scheduling new tests, running AI resume analyses, or launching practice environments require an active credit balance, the User will naturally be restricted from performing these actions until a successful payment is made and credits are replenished.

3.4. Absolute No-Refund & Anti-Chargeback Policy

  • Final Sale: All purchases—whether made online, via UPI, or through bank transfer—are final and strictly non-refundable.
  • No Pro-Rata Refunds: If a User cancels a recurring subscription mid-cycle, the cancellation simply prevents future automatic charges. The User will not receive a pro-rata cash refund for the current billing cycle. Any credits already deposited into the workspace during that cycle will remain available for use until their standard expiration date, and dashboard access to historical data will remain uninterrupted.
  • Service Interruptions: InterviewMix.com does not provide cash refunds or credit extensions for temporary service outages, maintenance windows, or client-side technical failures.
  • Chargebacks & Disputes: If a User initiates a bank chargeback or payment dispute for a valid charge, InterviewMix.com reserves the right to permanently ban the account, delete all associated data, and hold the User legally liable for the original transaction amount plus any dispute fees levied by the payment processor.

3.5. Credit Expiry & Forfeiture

  • Hard Expiry: Unused paid credits operate on a strict monthly cycle. They will expire at the end of the current billing cycle (defaulting to 28 days from the date of purchase), unless a different validity period is explicitly specified by the specific plan tier purchased. Note: Promotional credits may have a significantly shorter validity period as dictated at the time of issue.
  • Forfeiture on Ban: If an account is terminated due to a violation of these Terms (including, but not limited to, sharing login credentials, candidate malpractice, identity fraud, or attempting to reverse-engineer the Platform), all remaining credits and active subscriptions are immediately forfeited without refund or compensation.

3.6. Taxes, Currency & Bank Fees

  • Taxes: All advertised prices are exclusive of Goods and Services Tax (GST) and any other applicable regional taxes. Applicable taxes will be calculated and added to the final invoice.
  • Currency & Bank Fees: The User is solely responsible for any foreign transaction fees, exchange rate fluctuations, or overdraft charges levied by their own bank, UPI provider, or credit card issuer.

4. Account Security & Eligibility

4.1. Legal Capacity & Minors

Users (Hiring Entities and Candidates) represent that they are at least 18 years of age (or the age of majority in their jurisdiction) and have the full legal capacity to enter into a binding contract.

  • For Hiring Entities (Absolute Requirement): A User must be 18 years or older to create a Hiring Entity account, purchase credits, or act as an Account Owner/Admin. Minors are strictly prohibited from operating B2B accounts on InterviewMix.com. There are no exceptions to this rule.
  • For Candidates (Internships & Apprenticeships): If a Candidate is under 18, they are strictly prohibited from using the Platform for employment assessments unless the Hiring Entity has explicitly obtained, documented, and verified legally mandated parental or guardian consent prior to assigning the test.

4.2. Authentic Identity Policy

The information Users provide must be accurate, complete, and verifiable.

  • Real Name: Users must use their legal name as it appears on government-issued identification. Usage of aliases, nicknames, or pseudonyms is prohibited.
  • Valid Contact Info: Users must use a permanent, active email address. The use of temporary, "burner," or disposable email addresses is a violation of these Terms.
  • Verification: We reserve the right to request proof of identity (including, but not limited to, a LinkedIn profile, Government ID) at any time. Failure to provide proof within 48 hours may result in account suspension.

4.3. Prohibition on Ban Evasion

If a User has been previously banned, suspended, or removed from the Platform for any reason:

  • Permanent Bar: The User is permanently prohibited from accessing the Services.
  • No New Accounts: The User may not create a new account, use a different email address, or use a VPN/different IP address to circumvent the ban.
  • Liability: Any attempt to evade a ban is considered "Unauthorized Access" under the Information Technology Act, 2000, and we reserve the right to pursue legal action.

4.4. Corporate Authority (For Hiring Entities)

If a User is opening an account on behalf of a company, agency, or organization, that User represents that they have the authorized legal authority to bind that entity to these Terms. If the User does not have such authority, the User accepts that they are personally liable for all activity conducted, obligations assumed, and billing incurred under the account.

4.5. No Credential Sharing

Password and login sharing is strictly prohibited. Every User (Account Owner, Admin, or Candidate) must have their own unique account credentials. Sharing credentials with other team members or external parties is a material breach of these terms.

5. Role Definition & Technical Liabilities

5.1. Technical Infrastructure Provider Only

For the avoidance of doubt, InterviewMix.com acts solely as a Technical Infrastructure Provider (a "Data Processor" or "Intermediary"). We are NOT a recruitment agency, headhunter, or staffing firm. We do not represent the Candidate to the Hiring Entity, nor do we represent the Hiring Entity to the Candidate.

5.2. Limitation of Scope for Hiring Entities

We provide software tools to facilitate technical assessments. The Hiring Entity evaluates and employs Candidates at their own risk:

  • No Verification of Identity: While we offer proctoring features, we cannot guarantee with 100% certainty that the individual taking the test is the same individual who applied. The Hiring Entity is responsible for final identity verification.
  • Proctoring Fallibility & Evasion Risks: While we utilize advanced AI monitoring, no remote proctoring system is entirely foolproof. Candidates may devise novel methods to circumvent monitoring. InterviewMix.com does not guarantee that any assessment is completely free of malpractice.
  • No Guarantee of Competence: A high score indicates technical proficiency in specific questions, but it does not guarantee overall job performance, cultural fit, or soft skills.
5.3. Clarification for Candidates (The "No Influence" Clause)

Candidates acknowledge that InterviewMix.com does not have the authority to offer any job or reject any application.

  • We Do Not Make Hiring Decisions: We simply process the Candidate's code and answers to generate a technical score. We transmit this data to the Hiring Entity. We do not "pass" or "fail" a Candidate; we only provide recommendations.
  • The Client's Sole Discretion: The Hiring Entity retains 100% control over the selection process and may reject a Candidate for factors completely invisible to us (including, but not limited to, budget constraints or internal hires).
  • No Feedback Obligation: InterviewMix.com cannot provide feedback on why a Candidate was rejected. Direct all such inquiries to the Hiring Entity.
5.4. Disclaimer Regarding AI & Transcription Limitations

Our Platform utilizes AI and automated speech-to-text algorithms. Users acknowledge the following strict limitations:

  • AI is Probabilistic: AI models may occasionally produce false positives, false negatives, or "hallucinations." The Hiring Entity agrees to perform a mandatory human review before making final decisions based on AI flags.
  • Transcription Errors: Automated transcriptions are not infallible records and may contain errors due to, but not limited to, accents, microphone quality, or background noise.
  • Waiver of Liability: InterviewMix.com strictly disclaims all liability for AI-generated discrepancies, inaccurate transcripts, false cheating flags, or bad hiring decisions made by the Hiring Entity.
5.5. Platform Failures vs. Candidate Responsibility
  • Platform-Side Failures: If a verified technical failure originates solely from our infrastructure (e.g., a server crash during an active test), our sole liability is limited to refunding the consumed assessment credit back to the Hiring Entity's workspace. InterviewMix.com does not directly schedule, assign, or mandate re-tests. It is the sole discretion and responsibility of the Hiring Entity to use that refunded credit to issue a new test invitation to the affected Candidate. Candidates must direct all technical complaints, re-test requests, and deadline extension inquiries exclusively to the Hiring Entity. InterviewMix.com support cannot and will not process direct re-test requests from Candidates.
  • Candidate Responsibility: InterviewMix.com is NOT liable and will not refund credits to the Hiring Entity for assessment failures caused by client-side issues (including, but not limited to, candidate internet drops, hardware crashes, power outages, or browser extensions). Any request for a re-test due to a Candidate's local technical failure must be negotiated directly between the Candidate and the Hiring Entity.

6. Data Availability, Retention & Loss

InterviewMix.com is designed as an active assessment engine, not a permanent Applicant Tracking System (ATS) or permanent data storage facility. Users agree to the following data lifecycle terms:

6.1. Post-Expiry Read-Only Access

If a User’s paid subscription or credit balance expires, InterviewMix.com will, as a courtesy, maintain read-only access to historical dashboard data (e.g., past candidate scores, text transcripts). However, this read-only access is a courtesy, not a legally binding perpetual guarantee.

6.2. Dormant Account Purge

To enforce data minimization, any account that remains dormant (inactive) for a period of thirty-six (36) consecutive months will be permanently and irreversibly purged from our systems, including all historical candidate data, custom questions, and test results.

6.3. Business Continuity & Policy Modifications

  • Right to Modify or Terminate: We reserve the right to alter data retention policies, migrate infrastructure, or discontinue the Services at any time.
  • Notice of Deletion: In the event of a deliberate platform shutdown requiring mass data deletion, we will provide applicable data owners—specifically, Account Owners (for Hiring Entities) and Candidates (for personal practice plans)—with a thirty (30) day notice to export their data prior to permanent destruction.
  • Fulfillment of Notice: This notice requirement is considered fully and legally satisfied if delivered via an email to the User's registered email address OR by the posting of a prominent public banner on the Platform's main dashboard. Users acknowledge and agree that the presence of a platform-wide dashboard banner for the 30-day period constitutes absolute and sufficient legal notice, completely releasing InterviewMix.com from any liability, including, but not limited to, liability arising from email API restrictions, spam filters, bounced emails, or a User's failure to log in.

6.4. Catastrophic Data Loss & Export Responsibility

InterviewMix.com is built on highly secure, industry-leading cloud infrastructure designed for maximum reliability and data protection. However, Users acknowledge that no digital platform in the world is completely immune to unforeseen global internet outages, hardware failures, database corruptions, or sophisticated, unprecedented cyber-attacks ("Force Majeure").

  • User Responsibility to Export: It is the strict responsibility of the Hiring Entity to regularly export, download, and backup their candidates' final reports to their own internal systems.
  • Waiver of Liability: INTERVIEWMIX.COM SHALL NOT BE LIABLE TO ANY USER FOR THE LOSS, CORRUPTION, OR UNRECOVERABILITY OF ANY ASSESSMENT DATA OR QUESTION SETS, REGARDLESS OF WHETHER THE LOSS WAS DUE TO SYSTEM OUTAGES, VENDOR FAILURES, OR ACCIDENTAL DELETION.

7. Candidate Code of Conduct & Anti-Malpractice

To maintain the integrity of our assessment environment, InterviewMix.com strictly prohibits the following behaviors during any active test. Violation of these rules constitutes a material breach of these Terms.

Prohibited Actions:
  • Impersonation: Allowing a proxy, substitute, or any other individual to take the assessment on the Candidate's behalf (including, but not limited to, lip-syncing while another individual types).
  • AI Assistance: Using generative AI tools (including, but not limited to, ChatGPT, Claude, or GitHub Copilot) unless the specific test instructions strictly permit it in writing.
  • External Help: Browsing the internet for answers, utilizing secondary devices (e.g., smartphones, tablets), or communicating with other individuals (in-person or digitally) during an active assessment.
  • Circumvention & Evasion: Utilizing Virtual Machines (VMs), secondary monitors, screen-sharing, or remote-desktop software (including, but not limited to, TeamViewer or AnyDesk), modifying browser code, or intentionally disabling/obstructing the webcam or microphone.
  • Unauthorized Copy-Pasting: Copying code, text, or solutions from external sources (including, but not limited to, local desktop files, StackOverflow, GitHub, or other websites) and pasting them into the Platform editor, unless the specific test instructions strictly permit it in writing.
Enforcement & Reporting:We utilize automated proctoring systems, heuristic behavioral analysis, and AI technologies to detect the prohibited actions listed above.
  • Reporting: InterviewMix.com will automatically compile flags, logs, and evidence of suspected malpractice and transmit this report directly to the Hiring Entity.
  • Employment Decisions: As a technical intermediary, InterviewMix.com does not disqualify Candidates from jobs. The Hiring Entity retains sole discretion to evaluate the proctoring evidence and make the final disqualification or hiring decision.
  • Account Ban: Independent of the Hiring Entity's employment decision, InterviewMix.com reserves the absolute right to suspend or permanently ban a Candidate's platform account for violating this Code of Conduct. Our internal decision regarding platform account suspension will be final and binding. Furthermore, we reserve the full right to share, or not share, all gathered evidence of suspected malpractice with the respective Hiring Entity at our sole discretion.

8. Hiring Entity Code of Conduct

Hiring Entities are granted access to InterviewMix.com strictly to evaluate Candidates for legitimate employment, educational, or contractor opportunities. Hiring Entities must adhere to the following rules of conduct. Violation constitutes a material breach and will result in immediate account termination without refund.

  • A. Permitted Use & Prohibition on Data Harvesting:Hiring Entities are permitted to use the Platform strictly to evaluate Candidates for bona fide (genuine) employment, contract, or educational opportunities, whether hiring internally or sourcing for their respective clients.
    • The "Ghost Job" Ban: Hiring Entities shall not use the Platform to create fake assessments or "ghost jobs" for the purpose of harvesting Candidate data, emails, or resumes for data brokering, marketing lists, or non-employment-related commercial sale.
    • Lawful Sharing: If a Hiring Entity (such as a recruitment agency) shares a Candidate's assessment report with an external client, the Hiring Entity represents and warrants that it has the lawful right to do so under applicable data privacy laws. InterviewMix.com disclaims all liability for how Hiring Entities share or distribute Candidate reports to their clients.
  • B. Lawful & Non-Discriminatory Custom Questions:If a Hiring Entity utilizes the Platform to create custom assessment questions, the Hiring Entity is solely responsible for ensuring those questions comply with all applicable local, state, national, and international employment laws. Hiring Entities are strictly prohibited from utilizing the Platform to ask discriminatory, offensive, or legally restricted questions (including, but not limited to, inquiries regarding race, religion, sexual orientation, or medical history). InterviewMix.com strictly disclaims all liability for the content of custom questions. Any and all legal liability, regulatory fines, or candidate claims arising from custom questions are strictly limited to, and borne entirely by, the Hiring Entity.
  • C. Anti-Spam & Phishing:Hiring Entities shall not misuse the Platform's email invitation system to send unsolicited communications, spam, phishing links, or promotional material to Candidates.
  • D. Candidate Privacy & Dignity:Hiring Entities are granted access to Candidate assessment data (which may include proctoring flags, webcam snapshots, and code logs) strictly for internal evaluation purposes. Hiring Entities are legally prohibited from publishing, broadcasting, or sharing a Candidate's assessment data, proctoring images, code submissions, or scores on social media, public forums, or with unauthorized third parties without the Candidate's explicit written consent.
  • E. Protection of the Question Bank (IP):Hiring Entities shall not utilize automated scrapers, bots, or manual efforts to copy, export, download, or reverse-engineer InterviewMix.com's proprietary default question bank or grading algorithms. Furthermore, Hiring Entities are strictly prohibited from selling, publishing, distributing, or sharing any InterviewMix.com proprietary questions, test cases, or platform content on external websites, forums, or with third parties, whether for profit, to build a competing product, or for any other commercial or non-commercial purpose.
Neutral Intermediary & Hiring Entity Indemnification:
  • Technology Provider Status:InterviewMix.com operates exclusively as a neutral technology infrastructure provider. We are not an employer, recruiter, or employment agency. We do not evaluate Candidates, and we play absolutely no role in any employment, contracting, or rejection decisions.
  • Complete Release & Duty to Defend:Users acknowledge that any grievance, dispute, or legal action regarding assessment outcomes, hiring practices, or job rejections exists solely and exclusively between the Candidate and the Hiring Entity. The Hiring Entity agrees to fully indemnify, defend, and hold harmless InterviewMix.com from being named, subpoenaed, or otherwise dragged into any such dispute.
  • Cost Allocation:Should InterviewMix.com be inadvertently implicated in a claim, lawsuit, or regulatory action resulting from the Hiring Entity’s hiring practices, discriminatory actions, illegal custom questions, or mishandling of Candidate data, the Hiring Entity assumes total financial responsibility for all of InterviewMix.com's legal fees, court costs, and potential fines required to extract and legally remove InterviewMix.com from the dispute.

9. Intellectual Property & User Content

9.1. Our Intellectual Property (Strict No-Leak Policy)

All default assessment questions, hidden test cases, grading algorithms, UI designs, platform architecture, and underlying code are the exclusive, proprietary intellectual property of InterviewMix.com or its licensors. Candidates are strictly prohibited from copying, screenshotting, recording, or publishing InterviewMix.com assessment questions, test cases, or platform interfaces on external websites (including, but not limited to, LeetCode, Glassdoor, Reddit, Telegram, or GitHub). Violation of this policy will result in immediate account termination and potential legal action for intellectual property infringement.

9.2. Hiring Entity IP & Candidate Confidentiality

Hiring Entities may utilize the Platform to present custom coding challenges, proprietary business logic, or internal company data to Candidates. Candidates agree to maintain strict confidentiality regarding all custom questions and proprietary information presented to them by a Hiring Entity during an assessment. Candidates shall not copy, record, or distribute a Hiring Entity's proprietary custom questions. InterviewMix.com acts solely as a host and strictly disclaims any liability for a Candidate's unauthorized leak of a Hiring Entity's custom Intellectual Property. Any legal action regarding such leaks exists strictly between the Hiring Entity and the Candidate.

9.3. User Content & Processing License

Candidates and Hiring Entities retain all underlying ownership rights to the original content they submit to the Platform, including resumes, code submissions, and custom-created assessment questions ("User Content"). However, by submitting User Content to the Platform, Users grant InterviewMix.com a worldwide, non-exclusive, royalty-free, and sublicensable license to use, process, host, execute, and display the User Content solely for the purposes of providing, operating, securing, and improving the Services. This includes the explicit right to process User Content through automated grading algorithms, heuristic anti-cheat systems, and Artificial Intelligence (AI) features as outlined in our Privacy Policy.

9.4. License to Feedback

If a User provides InterviewMix.com with any comments, bug reports, feature requests, feedback, or suggestions ("Feedback"), the User hereby grants InterviewMix.com a perpetual, irrevocable, worldwide, and royalty-free right and license to use, implement, and monetize that Feedback for any purpose, without any obligation of compensation or attribution to the User.

10. Disclaimers of Warranty

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." INTERVIEWMIX.COM DOES NOT MAKE AND HEREBY DISCLAIMS ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, RELATED TO THE SERVICES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, TITLE, OR THAT THE SERVICES WILL BE UNINTERRUPTED, COMPLETE, ACCURATE, SECURE, ERROR-FREE, OR MEET ANY PARTICULAR NEEDS. INTERVIEWMIX.COM DOES NOT GUARANTEE THE ACCURACY, INTEGRITY, OR SAFETY OF ANY USER CONTENT.

11. Limitation of Liability

To the fullest extent permitted by applicable law, the following limitations apply:

No Indirect Damages:

INTERVIEWMIX.COM AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOST TIME, LOST DATA, LOST USE, DAMAGES TO GOODWILL, OR LOST EMPLOYMENT OR BUSINESS OPPORTUNITIES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE.

Total Aggregate Liability Cap

Our total cumulative liability for any claim arising out of these Terms or the use of the Services shall not exceed the greater of:

  • Providing a Retest (if technically available); OR
  • The amount paid by the User to InterviewMix.com for the specific Services giving rise to the claim during the twelve (12) months immediately preceding the claim; OR
  • A maximum monetary sum of ₹100 (Indian Rupees One Hundred).

12. General Indemnification

In addition to the specific indemnification provided by Hiring Entities in Section 8, all Users agree to defend, indemnify, and hold harmless InterviewMix.com, its affiliates, employees, contractors, and directors from all liabilities, claims, losses, and expenses (including reasonable attorneys’ fees) that arise from:

  • The User's misuse of, or access to, the Services and Platform.
  • The User's violation of these Terms of Service (including, but not limited to, malpractice, cheating, or leaking intellectual property).
  • The User's infringement of any intellectual property rights or third-party rights (e.g., pasting copyrighted code).
  • Any misrepresentation of identity or qualifications (Identity Fraud).

13. Termination & Suspension

  • Suspension for Security:InterviewMix.com may suspend a User's access to the Services, without notice, to resolve any actual or threatened technical risks, problems, or circumstances that pose a risk to the Services, the Platform, or third parties.
  • Termination for Breach:We reserve the absolute right to suspend or terminate any User's account and access to the Platform immediately and without prior notice at our sole discretion. This applies to any material breach of these Terms, unauthorized commercial exploitation, or any malicious conduct that actively damages the operational integrity or public reputation of InterviewMix.com.
    * Regarding Candidate Malpractice:

    If a Candidate's account is terminated or suspended due to suspected violations (including, but not limited to, cheating, rule circumvention, or identity fraud), InterviewMix.com is under no legal obligation to take any of the following actions (this list is strictly non-exhaustive and does not limit our rights):

    • Surrender records (including, but not limited to, internal system logs, video/audio recordings, or proctoring flags);
    • Disclose proprietary AI detection mechanisms or security algorithms; or
    • Provide specific "proof" of malpractice to the User to justify the termination.
    * Regarding Hiring Entity Breaches:

    If a Hiring Entity's account is terminated due to suspected Terms violations (including, but not limited to, data harvesting, IP scraping, or discriminatory usage), InterviewMix.com is under no legal obligation to take any of the following actions (this list is strictly non-exhaustive and does not limit our rights):

    • Surrender records (including, but not limited to, internal security audits or network logs); or
    • Provide specific "proof" of the violation to justify the termination.

    Furthermore, the Hiring Entity instantly forfeits all remaining credits and immediately loses all access to historical Candidate data.

  • Survival:All sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Indemnification, and Limitations of Liability) will survive the termination of a User's account.

14. Dispute Resolution & Class Action Waiver

14.1 Governing Law & Arbitration

This Agreement shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or controversy arising out of or in connection with these Terms (which is not amicably resolved within 21 days after the service of a written notice) shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996.

  • Appointment & Deadlock: The arbitration shall be conducted by a Sole Arbitrator mutually appointed by both parties. If the parties fail to reach a mutual agreement on the appointment within thirty (30) days from the date the arbitration notice is received, the arbitrator shall be appointed in accordance with the provisions of the Act.
  • Venue & Language: The seat and venue of the arbitration shall be exclusively in Bengaluru, Karnataka, India. All proceedings shall be conducted in the English language.
  • Mandatory Fast-Track Procedure: Regardless of the amount claimed (and notwithstanding the Limitation of Liability caps established in these Terms), the parties explicitly agree to utilize the Fast Track Procedure (Section 29B of the Act). The arbitration shall be conducted entirely based on written pleadings, documents, and email submissions, without oral hearings, in order to minimize legal costs and ensure a rapid resolution.

Subject to this arbitration clause, Users hereby expressly submit to the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka for any interim relief.

14.2 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL DISPUTES BETWEEN A USER AND INTERVIEWMIX.COM WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. USERS WILL NOT HAVE THE RIGHT TO BRING ANY CLAIM AGAINST INTERVIEWMIX.COM AS A PLAINTIFF OR MEMBER OF A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION BROUGHT BY OR ON BEHALF OF ANOTHER PERSON.

15. Miscellaneous

  • Limitation of Action: USERS AGREE THAT REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THESE TERMS OR USE OF THE SERVICES MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE OR IT WILL BE FOREVER BARRED.
  • Force Majeure: InterviewMix.com will not be liable for any delay or failure in performance resulting, directly or indirectly, from acts of nature, forces, or causes beyond our reasonable control, including internet failures, power outages, natural disasters, or governmental actions.
  • Severability: If any provision of these Terms is found to be unenforceable, that provision will be limited to the minimum extent necessary, and the remaining provisions will remain in full force.
  • No Waiver: Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
  • Assignment: Users may not assign their rights under these Terms. InterviewMix.com may assign its rights without User consent.
